Miguna Miguna sues CS Rachelle Omamo, Matiang’i in fresh move to gain Kenyan passport

Kenyan lawyer Miguna Miguna, who is currently exiled in Canada, has filed an application in court seeking the arrest and detention of Foreign Affairs Cabinet Secretary Raychelle Omamo.

According to the court application , Miguna is accusing CS Omamo and her Interior counterpart of curtailing the prospects of his return to Kenya. The firebrand lawyer now wants Omamo arrested and detained at Kamiti Maximum Prison.

“In the event of further failure to comply with orders of the Honorable Court order of citizen arrest be and is hereby issued to the citizens of the Republic of Kenya, jointly or severally, to arrest on sight, and deliver Amb. Raychelle Omamo, the Cabinet Secretary, Ministry of Foreign Affairs, the 4th Respondent herein to Kamiti Maximum Prison, pending further orders of the Honorable Court,” the court documents read in part.

In his application, Miguna accuses CS Omamo of going against a court order which ruled that he be issued with the necessary emergency travel documents that would necessitate his journey back to Kenya.

“In spite of being duly served aware of the said court order and notice of
penal consequences, the 4th Respondent has failed, and/or refused to comply and arrogantly persists in such refusal,” Miguna’s court application read in part.

Miguna further wants the court to compel CS Omamo to immediately make the necessary official moves that will enable him to acquire the necessary travel documents.

“That pending the hearing and determination of this application an Order be and is hereby issued directing Amb. Raychelle Omamo, the Cabinet Secretary, Ministry of Foreign Affairs, the 4th Respondent herein to immediately purge the contempt and enable the petitioner/applicant to obtain his Emergency Travel Document from the Kenya High Commission Ottawa (Canada) or the Kenya High Commission Berlin (Germany) or from wherever he is immediate as ordered by the Honorable Court on 22nd November 2021,” the court further read.

The lawyer further wants to be compensated by Air Lufthansa, Air France and the state stating that he spent over Ksh1 million which he used in his aborted trips to jet into the country last year.

“I spent more than $10,000 on this latest trip. Besides, I spent an equivalent amount in March 2018 and January 2020 when the state prevented me from entering Kenya,” Miguna said.
